New Jersey Ignition Interlock Requirements and Guidelines

New Jersey residents may have heard of ignition interlock devices (IIDs), but many likely have questions about what offenses require installation of the devices. IIDs are a typical part of the sentence for DWI offenders. It is important to be aware of what the mandatory standards are for using IIDs to avoid any additional penalties.

Ignition interlock devices are mandatory for first-time DUI offenders with blood alcohol contents (BACs) of .15% or higher. However, the required term for using IIDs varies and is within a judge’s discretion. Generally, a judge can require use of an IID throughout the license suspension period, plus between six months to one year after the license is restored (for first offense DUI). This time increases to between one and three years for additional offenses.

When IID requirements are imposed by judges, defendants receive detailed instructions on how to install the IIDs. Defendants are responsible for the cost of installation.

IIDs must be installed on any vehicle that the driver might operate, even another person’s car. This requirement is mandatory even if the driver does not plan to do any driving during the suspension period.

Moving out of New Jersey does not eliminate the IID requirement and may result in problems restoring driving privileges in a new state. The IID must remain on any vehicle that the driver operates in the new state.

It is important to obey a judge’s order requiring use of an IID. Failing to install the device can result in the judge adding an additional year to the suspended license term.
