In most states, it is legal to simply not report a crime, but there are some exceptions. In some cases, there are states, like Texas, that make it mandatory to report higher offense crimes. Failure to do so could lead to a misdemeanor. In a state like Ohio, it is illegal to not report a felony.
In most other states though, there is no mandatory law that states you must report a crime, except for in the following scenarios:
There are instances in many states where it is illegal to not report a certain type of crime. In most states, there are mandatory reporting laws that state anyone aware of a crime against children must report the crime. Whether this be child abuse, child neglect, child pornography, etc., many states have a law that an individual must report a crime regarding children.
Also, there are many states that charge an individual that doesn’t report a crime in hopes to conceal it. A person who has knowledge of a crime, but covers it up to help the criminal, can actually be charged as an accessory to a crime. This is not the same as failing to report a crime, because it entails that the person was purposefully hiding information in order to cover for the criminal. Again, this is a crime in and of itself.
Other than the above mentioned situations, there are a few other odd instances where it is illegal to not report a crime as well, but if you’ve been charged after failing to not report a crime the best bet is to consult an experienced attorney.
